Digital Influence, LLC, (“Digital Influence”), respects your privacy and is committed to protecting the personal information that you share with us, that is provided to us in connection with our products or services or that we otherwise receive. This Digital Influence Privacy Policy describes how we collect and use your personal information.

Protecting the privacy and security of this personal information is central to Digital Influence’s mission. Even if you are not a California resident, please note that the section titled “Privacy Notice for California Residents” includes information that is applicable generally. This Digital Influence Privacy Policy governs personal information collected by Digital Influence for our own purposes as well as information provided to us as a data processor for our customers. It applies to information collected both online and offline, including through Digital Influence’s websites and applications, including the Digital Influence Casting IOS App and the StarNow Audition Finder IOS App.

Digital Influence is also committed to transparency. We want individuals to understand how we collect and use personal information so they can interact with Digital Influence with confidence. The information below covers how we collect, use, disclose, transfer, and store your information. Privacy Notice for California Residents / Notice at Collection

This Privacy Notice for California Residents supplements the information provided in this Digital Influence Privacy Policy and applies solely to all California residents (“consumers” or “you”) as defined by the California Consumer Privacy Act of 2018 (CCPA), as amended by the California Privacy Rights Act of 2020 (CPRA) (collectively, “California Privacy Laws”). We are adopting this Notice to comply with the California Privacy Laws and any terms defined in the California Privacy Laws have the same meaning when used in this notice.

Information We Collect

We collect personal information when you register with us for an account, when you use certain Digital Influence products or services, when you visit our websites, when you use our applications, when you participate in a survey, when you ask to be included in an email or other mailing list, or when you submit your personal information to us for any other reason. We receive personal information from or on behalf of our customers in connection with our provision of products and services such as our software. We also receive personal information from business partners, vendors, and government entities.

Depending on how you interact with Digital Influence, in the last twelve (12) months, we may have collected the following categories of information as summarized below:

Identifiers (for example, name, address, email address, phone number, username)

Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)) (for example, name, physical characteristics or description, address, phone number, employment history)

Protected classification characteristics under California or federal law (for example, race, ethnicity, age, gender, or other demographic information)*

Professional or employment-related data (position, role, occupation, previous work experience, or current or former employer, business contact information)

Commercial information (for example, purchase history, financial information, billing information, information that is generated through your other actions when you use our products and services and which is linked to your account)

Internet or other similar network activity (for example, search history, information on a consumer’s interaction with a website, application, or advertisement)

Geolocation data, to the extent it can be derived from other information collected from or about you (for example, precise location data of your mobile device when enabled, general location, IP address)*

Professional or employment-related information (for example, work history, union membership)*

Account log-in or financial account information allowing access to an account (for example, financial account or credit card numbers in combination with any required access codes or passwords)*

* Includes “sensitive personal information” as defined by the California Privacy Laws (not used or disclosed for any purpose requiring a consumer right to limit under the California Privacy Laws).

We retain personal information for as long as needed or permitted in light of the purpose(s) for which it was collected. The criteria used to determine our retention periods include:

The length of time we have an ongoing relationship with you (for example, for as long as you have an account with us) and the length of time during which we may have a legitimate need to reference your personal information to address issues that may arise.

Whether there is a legal obligation to which we are subject (for example, if we are required to keep certain records for a period of time before we can delete them).

Whether retention is allowed by applicable law (for example, based on litigation or regulatory investigations).

Personal information does not include:

Publicly available information.

Deidentified or aggregated consumer information.

Information excluded from the California Privacy Laws’ scope.

Use of Personal Information

We may use or disclose (to our customers, business partners, vendors, and others as required by law) the personal information we collect for one or more of the following business and commercial purposes:

To fulfill or meet the reason a party provided the information.

To create, maintain, customize, and secure your account with us.

To provide you with support and to respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses.

To help maintain the safety, security, and integrity of our websites and applications, products and services, databases and other technology assets, and business.

To provide, support, personalize, and develop our products and services.

For testing, research, analysis, and product development, including to develop and improve our product, services, and our websites and applications.

To respond to law enforcement requests and as required by applicable law.

As described to you when collecting your personal information or as otherwise set forth in the California Privacy Laws.

Other uses that we notify you about.

Digital Influence will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice. Digital Influence does not sell (as defined by the California Privacy Laws) your personal information.

Digital Influence may disclose your personal information for a business purpose to a third party with your consent or where required in order to provide products or services to you or our customers in accordance with federal and state law.

California Rights and Choices

The California Privacy Laws provide California residents with specific rights regarding their personal information. This section describes your California Privacy Laws rights and explains how to exercise those rights.

Access to Specific Information

You have the right to request that Digital Influence disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

The categories of personal information we collected about you.

The categories of sources for the personal information we collected about you.

Our business or commercial purpose for collecting, selling or sharing that personal information.

The categories of third parties to whom we disclose that personal information.

The specific pieces of personal information we collected about you.

If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:

sales, identifying the personal information categories that each category of recipient purchased; and

disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.

Correction Requests

You have the right to request that Digital Influence correct any inaccurate personal information about you that we maintain.

Deletion Requests

You have the right to request that Digital Influence delete your personal information that we collected and retained.  However, due to the nature of the products and services that Digital Influence provides, it is likely that we will be required to deny your deletion request due to legal and regulatory requirements and our contractual obligations with our customers.

In general, we may deny your deletion request if retaining the information is necessary for us or our service providers to:

Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.

Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

Debug products to identify and repair errors that impair existing intended functionality.

Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.

Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).

Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.

Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.

Comply with a legal obligation.

Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

In the event that none of the above exceptions apply, we will delete your personal information from our records once we receive and confirm your verifiable consumer request for deletion.

Opt-Out of Sharing

You have the right to opt-out of the sharing of your personal information. Share is defined under the California Privacy Laws to include the transfer of personal information to third parties for cross-context behavioral advertising purposes. We use cookies, pixels, and similar technology, and we share certain information, such as your IP address or device identifiers, to certain third-party advertisers in order to improve your user experience and to optimize our marketing activities. You have the right to direct us not to share or use your personal information for cross-context behavioral advertising purposes.
